Ceramic Studio Waiver and Participation Agreement
By registering for, attending, or participating in any class, workshop, open studio session, or instructional activity at The Clay Pit, the participant acknowledges, understands, and voluntarily agrees to the following terms and conditions.
1. Scope of Activities
This agreement applies to all ceramic classes, workshops, private lessons, open studio access, demonstrations, and related activities offered by The Clay Pit, whether instructed by employees, contractors, volunteers, or guest artists.
Participation is voluntary and provided in exchange for payment or permission to participate.
2. Acknowledgment and Assumption of Risk
The participant understands and acknowledges that participation in ceramic studio activities involves inherent risks. These risks include, but are not limited to, cuts, burns, slips and falls, repetitive motion injuries, exposure to clay dust and glaze materials, use of sharp or heavy tools, kiln heat, equipment malfunction, and handling of wet or fired ceramic work.
The participant knowingly and voluntarily assumes all inherent risks associated with ceramic studio activities, whether such risks are known or unknown, foreseeable or unforeseeable.
3. Health and Personal Responsibility
The participant represents that they are physically and mentally capable of safely participating in ceramic activities. The participant is solely responsible for determining whether participation is appropriate given their health, medical conditions, allergies, pregnancy status, or physical limitations.
The Clay Pit does not provide medical advice or supervision.
4. Studio Rules and Safety
Participants agree to comply with all posted studio rules, safety policies, and verbal instructions provided by instructors or staff. Failure to follow rules or engage in safe conduct may result in removal from the studio without refund.
5. Tools, Materials, and Personal Property
Participants agree to use tools, materials, and equipment only as instructed. The Clay Pit is not responsible for loss, theft, or damage to personal property brought into the studio.
6. Artwork and Firing Outcomes
The participant acknowledges that ceramic work may crack, warp, glaze improperly, or be damaged during drying, handling, or firing. The Clay Pit makes no guarantees regarding the outcome or survival of artwork.
All firing is subject to studio firing policies and any separate kiln firing agreement in effect.
7. Release of Liability for Ordinary Negligence
To the fullest extent permitted by Minnesota law, the participant releases and discharges The Clay Pit, its owners, employees, instructors, volunteers, contractors, and agents from any and all claims arising out of ordinary negligence related to participation in ceramic studio activities.
This release does not apply to gross negligence, reckless conduct, or intentional wrongdoing, which cannot be waived under Minnesota law.
8. Indemnification
The participant agrees to indemnify and hold harmless The Clay Pit from any claims, damages, losses, or expenses, including reasonable attorneys’ fees, arising from the participant’s failure to follow studio rules, misuse of equipment, or unsafe conduct.
9. Photography and Media Release
The participant grants permission for The Clay Pit to photograph or record studio activities and to use such images or recordings for promotional or educational purposes without compensation, unless the participant provides written notice declining consent prior to participation.
10. Cancellations and Refunds
Class and workshop fees are generally nonrefundable unless otherwise stated in writing. If a participant is unable to attend a scheduled class, The Clay Pit may, at its discretion, offer a credit toward a future class or workshop, subject to availability. Missed classes are not guaranteed to be made up, but may be accommodated when possible. The Clay Pit reserves the right to cancel or reschedule classes as necessary, and in such cases, participants will be offered a refund or credit.
11. Minors
Participants under the age of 18 must have this agreement accepted by a parent or legal guardian. The parent or guardian acknowledges and agrees to all terms on behalf of the minor participant.
12. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the State of Minnesota.
13. Voluntary Agreement and Electronic Acceptance
By registering for or participating in any class or studio activity, the participant affirms that they have had sufficient time to review this agreement, understand its terms, and voluntarily agree to be bound by it. Electronic acceptance, including a checkbox acknowledgment or an electronic signature, constitutes a valid and binding agreement.
